    Housing Discrimination - Fair Housing

    The Fair Housing Act protects people from discrimination when they are renting or purchasing a home, getting a mortgage, seeking housing assistance, or taking part in other housing-related activities.

    Fair Housing Information

    Find information listed below on who and what is covered under the law.

    The Fair Housing Act prohibits discrimination in housing because of:

    - Race.
    - Color.
    - National Origin.
    - Religion.
    - Sex.
    - Familial Status.
    - Disability.
    What Is Prohibited?

    In the Sale and Rental of Housing:

    It is unlawful discrimination to take any of the following actions due to the fact that of race, color, religious beliefs, sex, special needs, familial status, or national origin:

    - Refuse to lease or sell housing.
    - Refuse to negotiate for housing.
    - Otherwise make housing not available.
    - Set various terms, conditions or advantages for sale or rental of a house.
    - Provide a person different housing services or centers.
    - Falsely reject that housing is readily available for assessment, sale or rental.
    - Make, print or publish any notice, declaration or ad with regard to the sale or rental of a residence that indicates any preference, restriction or discrimination.
    - Impose different list prices or rental charges for the sale or leasing of a house.
    - Use various qualification criteria or applications, or sale or rental requirements or treatments, such as earnings standards, application requirements, application fees, credit analyses, sale or rental approval procedures or other requirements.
    - Evict an occupant or an occupant's visitor.
    - Harass an individual.
    - Fail or hold-up efficiency of upkeep or repairs.
    - Limit benefits, services or facilities of a residence.
    - Discourage the purchase or leasing of a dwelling.
    - Assign a person to a specific building or area or section of a building or neighborhood.
    - For revenue, encourage, or attempt to convince, homeowners to offer their homes by recommending that people of a particular protected quality will move into the area (blockbusting).
    - Refuse to provide or discriminate in the terms or conditions of property owners insurance coverage due to the fact that of the race, color, faith, sex, impairment, familial status, or nationwide origin of the owner and/or occupants of a residence.
    - Deny access to or subscription in any several listing service or real estate brokers' organization.
    In Mortgage Lending:

    It is prohibited discrimination to take any of the following actions based on race, color, faith, sex, special needs, familial status, or nationwide origin:

    - Refuse to make a mortgage loan or supply other financial assistance for a dwelling.
    - Refuse to supply information regarding loans.
    - Impose various terms or conditions on a loan, such as different interest rates, points, or fees.
    - Discriminate in evaluating a house.
    - Condition the schedule of a loan on an individual's action to harassment.
    - Refuse to buy a loan.
    Harassment:

    The Fair Housing Act makes it illegal to pester persons since of race, color, faith, sex, disability, familial status, or national origin. Among other things, this forbids unwanted sexual advances.

    Retaliation and Other Prohibitions:

    It is prohibited discrimination to:

    - Threaten, push, daunt or hinder anyone exercising a reasonable housing right or helping others who work out the right.
    - Retaliate against an individual who has filed a reasonable housing complaint or assisted in a reasonable housing examination.
    Reasonable Accommodations and Reasonable Modifications

    Under the Fair Housing Acts a reasonable lodging is a change, exception, or modification to a guideline, policy, practice, or service. The Fair Housing Act makes it illegal to refuse to make reasonable lodgings to guidelines, policies, practices, or services when such lodgings may be necessary to pay for individuals with disabilities a level playing field to use and enjoy a house and public and typical usage areas.

    In addition, the Fair Housing Act restricts a housing company from refusing to allow, at the cost of the person with an impairment, affordable modifications of existing premises inhabited or to be occupied by such individual if such modifications might be necessary to pay for such individual full enjoyment of the facilities.

    What is Needed for a Problem

    To submit a housing discrimination complaint these requirements should be satisfied:

    - The residential or commercial property should be within the state of Texas.
    - The residential or commercial property owner, for the most part, must have more than 3 residential or commercial properties. This does not include multi-family houses.
